Terms of service
Between you and the operator named in the Impressum (“we”). Plain language on purpose; where it matters, the legal term is given.
1. What this is
Proberaum is a web application for bands to keep track of the songs they rehearse: rating them, ordering them, attaching recordings and practice loops, and building setlists. Everything belongs to a bandspace, which is shared by its members and invisible to every other band.
2. Accounts
One account per person. Give a working email address — it is the only way to reset a password or to reach you about your account. Keep your password to yourself; anyone holding it can read and delete your band's material.
Inside a bandspace the trust model is flat and deliberately so: any member may add, edit or delete any of that band's songs, may invite others with the invite code, and may switch the bandspace to Premium. Share the code only with people you would give that to.
3. Plans and payment
Jam mode is free. Band mode and Gig mode are Premium, which belongs to the bandspace rather than to an account and costs nothing today: one click grants 30 days, any member may renew it, and nothing is charged. If that ever changes you will be asked first — no account will start being billed by surprise.
When Premium lapses, nothing is deleted. Band and Gig mode stop opening; recordings, loops and setlists are exactly where they were when somebody renews.
4. What you upload
Your band's material stays your band's. You grant us only what is needed to run the service — to store your files, to serve them back to the members of your bandspace, and to keep backups. Nothing is published, shared with other bands, sold, or used to train anything.
You are responsible for what you upload. A rehearsal recording of a cover version can involve someone else's rights, and a recording of a rehearsal involves everyone who was in the room. By uploading it you confirm that you may, and that the people on it agree.
Storage is limited per bandspace; the current allowance is shown on the Premium page.
5. Notice and takedown
If you hold rights in a work and believe material here infringes them, write to chris@christian-marek-analytics.de with:
- what the material is and where it is (a link, or the band and song),
- what right you hold and on what basis,
- your contact details, and
- a statement that your complaint is made in good faith.
We aim to acknowledge within three working days. Where a complaint is substantiated we remove or block the material and tell the band that uploaded it, so they can respond. Repeated infringement ends a bandspace's access.
6. Use of the service
Do not use it to store or distribute material that is unlawful, to attack the service or other users, to circumvent the storage or plan limits, or to collect other people's data. We may suspend an account or a bandspace that does, and will say why.
7. Availability
This runs on a small, single-region deployment, and no uptime is promised. There are maintenance windows, there are deployments, and there will be outages. Keep your own copy of anything you could not stand to lose — the export on your account page and on the bandspace page exists for that.
8. Ending it
You may delete your account at any time from your account page; what is deleted and what stays with your band is described there and in the privacy policy. We may terminate an account for a serious or repeated breach of these terms, with notice where that is possible.
9. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only where an obligation essential to the purpose of this agreement is breached, and then only for the damage typically foreseeable. Liability under the Product Liability Act is unaffected.
10. Law and jurisdiction
German law applies, without prejudice to the mandatory consumer protection of the country you live in. If you are a merchant or a legal entity under public law, the place of jurisdiction is the operator's seat.
11. Changes to these terms
We will tell you about material changes by email to the address on your account, before they take effect. If you do not agree, delete the account — take your data with you first, with the export.
